"CANADIAN JUSTICE SYSTEM AND THE ENDLESS STRUGGLE AGAINST IMPUNITY”



The circus continues its course in the courtrooms of the impunity, with a “Roll of honor” of 13 jurors carefully chosen by a corrupt judicial system, a squad of witnesses highly selected as of habitual for theses criminal cases. As also could not be absent the mainstream media manipulating the public opinion, but the family of the young Sammy Yatim is grieving inside of the courtroom the loss of their loved one and desperately claiming justice for his son.

Toronto police Const. James Forcillo, on trial for second degree murder, has pleaded not guilty to killing Sammy Yatim, whom he shot dead in a hail of gunfire.

The final witness in the murder trial of Toronto police Const. James Forcillo was forced to interrupt her testimony as she sobbed uncontrollably while the court heard audio of her 911 call on the night Sammy Yatim died.
Bridgette McGregor, 27, spoke through tears with a quavering voice as she described the terror and chaos on the Dundas St. streetcar in July 2013.
She had gone to a Justin Bieber concert that night with her niece and two sisters, and the group was sitting at the back of the streetcar next to Yatim when he pulled out a knife and exposed his penis, McGregor said.
“I need you to know that Yatim was dangerous,” she told the jury after she broke down crying on the stand.
Forcillo is on trial for second degree murder. He has pleaded not guilty.
The court has heard that the 18-year-old pulled a knife on a crowded streetcar, causing the passengers to flee.

He was then shot and killed by Forcillo as he stood alone at the front of the empty streetcar.
On Tuesday, McGregor and her older sister Christy were the last witnesses called by defence lawyer Peter Brauti.
Speaking through tears, the sisters described how they attended a concert at the Air Canada Centre, walked by the CN Tower taking pictures, then took the Spadina streetcar north to board the westbound streetcar on Dundas St. W.
The three women and 12-year-old girl sat at the back of the streetcar, next to Yatim, who stuck out his leg as they sat talking about the concert and boy bands from their youth.
“I was uncomfortable because he was shifty at first,” said Christy McGregor. “Now I’m getting on guard. I’m thinking, ‘This is weird.’ ”
She said that she then noticed her daughter’s eyes get wide.
“The next thing I see is a flash of silver and I realize, ‘Oh my God it’s a knife,’ ” she told the court.
Yatim then reached out with the knife and held it near her sister Bridgette’s neck, Christy McGregor said.
“I was sure he got her, it came so close,” she said. “Screaming starts. All hell breaks loose at this point.”
Bridgette McGregor said she doesn’t recall the knife near her neck, but that she agrees that it happened, because she has seen video of the incident from inside the streetcar.
“I didn’t notice the knife at first. I only noticed he had his penis out,” she said while crying on the stand. “He was pulling on it. Masturbating . . . .The next thing, I remember is he’s standing in front of me.”
She said Yatim told her she’s “not going anywhere,” and that she held up her purse with her hand behind it to block the knife as Yatim pressed it toward her.
She managed to “scurry” around him and run toward the front of the streetcar, she said.
“I yell, ‘Open the doors, why won’t you open the doors? He has a knife!’ ”
When the doors opened, the group ran west for about a block because they feared Yatim could be chasing them, she said. They stopped when someone suggested calling 911.
Audio of the call was played in court, but cut short as Bridgette McGregor began to shudder and weep at the sound of her screaming voice in the recording.
Moments later under cross-examination from Crown lawyer Ian Bulmer, McGregor said the recording captured the moment that shots rang out on Dundas St., and that, at the time, she feared that Yatim was firing a gun.
“You’re glad he was shot by police that night,” Bulmer suggested.
Bridgette McGregor responded: “No.”
Bridgette and Christy McGregor said they didn’t tell their story to police or have any interactions with law enforcement until after Yatim was shot.
The trial resumes Jan. 5 when the Crown and defence begin their closing arguments.

The Duplessis Orphans: 20,000 Intentional Misdiagnoses

In A Nutshell

From 1940 to 1960, the Canadian government in Quebec, in conjunction with the Catholic Church, falsely diagnosed thousands of children with mental illnesses, so they could be placed in institutions run by the Church. Many of the orphans were forcibly taken from their mothers by Catholics because their parents were unmarried. In addition, many of them were abused, and some may have been medically experimented on.

Starting in the 1940s and continuing through the 1950s, the Canadian government of the province of Quebec conspired with the Catholic Church to send thousands of orphaned children into Church-run institutions by falsely diagnosing them with mental illnesses. They are known as the Duplessis Orphans, named after Quebec Premier Maurice Duplessis, who was in power during their imprisonment. Some of the children were abandoned by their parents but many were forcibly taken by the Church because they were “children of sin,” babies born out of wedlock.

The main reason for this scheme is simple and universally understood: money. Additional funding from the Canadian federal government was given to institutions which cared for mentally ill children and Duplessis and the Church wanted as many dollars as they could get. So almost all of the orphans were said to have mental illnesses and were shipped to insane asylums. When those filled up, existing orphanages were converted, so as to make more beds available for the “mentally ill.”

In addition, many of the children underwent constant physical, emotional, and sexual abuse at the hands of the nuns and priests who ran the institutions. Some of the orphans were also said to be the victims of medical experimentation, including electroshock therapy and lobotomies. (One survivor, Paul St. Aubain, stated: “They were experimenting with me. I was a prisoner.”) Many of those who were experimented on may have died, with one orphan saying he transported at least 60 corpses: “Some of these people died on the operating table. Some had been sick and some had committed suicide.”

In 2002, a group of around 1,100 surviving orphans settled with the Quebec government, receiving $25 million in compensation, with the requirement they not attempt to sue the Catholic Church. However, to this day, no apology has been issued from either the Quebec government or the Catholic Church for the 20,000 lives they destroyed.

The homeless hub                                                                                                                                                                  Foster Care                                                                                                     Foster care is linked to homelessness in two ways. Firstly, a foster care history is linked to later homelessness. Secondly, children of homeless families are more likely to end up in foster care. Childhood placement in foster care corresponds with a substantial increase in the length of a person’s homeless experience, an increased tendency for homeless people to have their own children end up in foster care, and a heightened likelihood that they will become homeless earlier than people who have not been in foster care. People who are homeless typically have a number of placements as children, both in foster care and in the homes of friends and family.

There are a number of reasons that foster care could lead to homelessness. While in foster care, children are not always given therapy to help them address the problems that brought them to foster care. This may include sexual and physical abuse, family dissolution, parent alcohol and substance abuse, and being abandoned or orphaned. Nor do they receive treatment for their own resulting behavioral problems.

Foster care placements can also be abusive places as many people have been physically or sexually abused while in foster care. Multiple placements can preclude the development of the nurturing bonds that have been shown to be critical to normal development. Moving children from placement to placement seems to exacerbate the inability of the foster care system to provide them with consistent treatment for their mental or physical health problems.

impunity has started, with the mainstream media manipulating the public opinion, the judicial system with 13 honorable jurors very well selected, a "Honor's Roll" that are debating inside of the courtroom of the impunity, and a family who is grieving and desperately is claiming justice for his son.

 Like in the Nazi Germany the Gestapo feared police, were given huge powers to commit all kinds of crimes. Likewise in Canada the Toronto police have developed a policy of intimidation, fear, brutality and death. The public execution and tasering of Sammy Yatim by Officer James Forcillo and his partner proves the murderous instinct of the Toronto police officers. How are they trained to commit heinous crimes; and the manner that the Toronto police force administrates the law with their own hands?

The Canadian criminal justice system prides itself on its adherence to the rule of law and unbiased justice for all within a framework of integrity and tradition. Law enforcement is an integral part of the criminal justice system, the current principles of which were created within a structural functional framework in the 1950’s era that considered social order as the most valuable norm to society. The structural functional framework works within the ideology that if one part of the system is broken, then the system as a whole is dysfunctional. Structural functionalists believe that in response, the system will morph into a new, improved version that will resolve any apparent dysfunctions. It is clear that society’s norms and values have changed since the 1950’s, as evident in evolving gender roles, increased cultural acceptance, and tolerance. Why then has the criminal justice system, well documented in its continued support of
White male domination, been so slowly to catch up with new social norms? This essay will examine the systemic structural problems inherent within the policing system of Canada and the pervasive inequality and corruption that it perpetuates. I will examine the variables of public perception, along with police deviance and culture to outline a framework response around the issue of structural deficiencies and its prevention of social equality within the Canadian criminal justice system.
