The task force on Toronto Community Housing Corporation, headed by Senator Art Eggleton, has proposed bold strategic change. TCHC houses about one-quarter of Greater Toronto's tenants with low incomes, so its future is important for the health and social well-being of this city and region.
Two things stand out in its many recommendations: a new structure for the organization, and better support for tenants with special needs. Although our former mayor blamed the problems on poor management, the report makes it clear that the problems are broader and the fix must be strategic.
The first move is to separate the role of running buildings and serving tenants from the renewal of property assets to meet long-term needs. For most of its 14 years of life, TCHC has put efforts into saving costs on property management, and building up its expertise and track record in development. Its revitalization of Regent Park and other communities is widely celebrated and its expertise is recognized. The side that has suffered is responsiveness to tenants, the people that TCHC exists to serve.
A landlord with a couple of hundred large old buildings, home to people with low incomes, social disadvantage, and old age or disabilities or kids, must have much more than basic property management. It needs tenant relations staff, security staff, community and youth workers, and ways to link tenants to services in the surrounding community. A call centre is no substitute for responsive staff on the ground. And it is hard to do this well if the development arm is first in line for available dollars and attention.
The task force's solutions are decentralized property management and transferring the management of various properties to community-based non-profits.
Some concerns are being voiced that this is selling public assets, offloading responsibility, or abandoning tenants. But the City has another main role in social housing besides TCHC. This is to fund, coordinate and oversee a system of almost 90,000 affordable units, one-third of them in community-based non-profits and co-ops. The City does this expertly and there are lots of safeguards to ensure those groups' accountability and capacity. The success story of Canadian social housing a generation ago wasn't about low-income government projects - it was mixed-income community housing in a system funded and overseen by government. British Columbia and the United Kingdom take this approach further and do far better than Ontario.
A separate corporation would do long-term asset management. If we want to renew those aging 90,000 units once they hit the 50 or 60-year mark, we need to ramp up activity. If the federal government comes through on its promises about social infrastructure funding we can make a serious start. This activity fits with the City's funding and system management role, not its role in operating housing and serving tenants.
When public housing was built in the 1960s and '70s, a majority of tenants were either working poor or seniors in their 60s. Today, it has unfortunately become housing of last resort. Many seniors are in their 80s and need home care. More intake priority has been given to people with mental health disabilities or who were homeless, and many of these residents need extra support. Many TCHC family buildings sit in neighbourhoods that were once ordinary working-class areas but are now quite poor, and kids face real disadvantages that demand active community programs.
So the task force recommends that TCHC or its successor get systematic about partnerships with community agencies for seniors services and mental health, and the Local Health Integration Networks that fund them. The report points to successful TCHC pilot programs in partnership with LHINs and those agencies.
The Ontario government has announced its intention to reform LHINs, giving them direct responsibility for home care, as well as a role in public health that must mean a stronger relationship with the City. This is an opportunity to make sure that health-funded housing supports are built into LHIN priorities and LHIN-municipal collaboration. The money required would be a fraction of a penny on every dollar of health spending.
The task force's recipe is fundamental change, and there are many questions that need answers and call for due diligence. Senator Eggleton stated on Tuesday that the first and foremost problem is funding, and the largest challenges there are unresolved. But this is an opportunity to seize, to carry out some big changes and ensure that decent housing supports the health and well-being of Toronto residents.

Forcillo lawyer pins blame solely on Yatim

TORONTO - There were hours and hours of argument, justifications and defences, but hardly a second of sympathy for the teen shot eight times by Const. James Forcillo.
To be fair, that’s not the job of defence lawyer Peter Brauti. His task is to win the acquittal of the young police officer facing life in prison if convicted of second-degree murder. And yet, it bristles just the same that he wastes so few words on 18-year-old Sammy Yatim, brutally gunned down on an empty streetcar: “To be clear, no one likes the end result in this case. Mr. Yatim was shot and killed and nothing is going to change that,” Brauti told the jury. “There can be no doubt that while Mr. Yatim may not have been a perfect young man, he will be missed by his family.
“However, the answer to this case is not to take Officer Forcillo away from his family — his wife and two very young daughters.”
As he launched into his exhaustive, two-day closing address, Brauti pinned the blame solely on the victim, suggesting Yatim, high on MDMA and armed with a switchblade, was looking for a showdown with police and got exactly what he wanted.
“We have our own theory about why Mr. Yatim acted the way he did. And we started to bring forward that evidence by suggesting that on this night, for a number of reasons, Mr. Yatim was interested in a confrontation with the police. However we did not call the evidence we wanted to on that point and you should not speculate as to what the evidence might have been,” the lawyer said cryptically.
Yatim, Brauti added later, had a “wanton disregard for his own life and the life of others” that night.
It doesn’t matter what his state of mind was on that July night in 2013, the lawyer insisted. Was it just false bravado, with Yatim playing tough. acting like Clint Eastwood with his clenched jaw and an attitude of ‘Bring it on, I’m not afraid?’”
Or was he seriously ignoring repeated demands to drop his knife because he planned to attack the officer and that’s why he turned “confrontational, aggressive, angry and ... challenging” as soon as he saw police arrive?
We’ll never know his true intentions, Brauti maintained, and we can’t expect Forcillo to have known, either. “He is not a psychologist and he is not a mind reader. He is a first responder.”
He had to react to the behaviour he saw — which appeared threatening and dangerous. Faced with an imminent threat — Brauti claimed the video shows Yatim flicking his knife at Forcillo — he said the cop was legally justified to open fire, both in self-defence and as a police officer who reasonably believed that lethal force was necessary to protect himself and others.
Obliged to speak first, Brauti was in the tough position of having to anticipate the arguments prosecutors will make in their own closing address. And so he methodically dismissed all the Crown theories as desperate, weak, distracting and ludicrous: Forcillo wasn’t panicked, angry or reckless; Yatim wasn’t planning to surrender and he couldn’t have been talked down with an offer of water or a more gentle approach.
Yatim had brazenly ignored all warnings, Brauti suggested, “He got himself shot.”
It’s easy for us to second guess Forcillo now, his lawyer argued. We weren’t faced with those 50 seconds of high tension; we weren’t asked to gamble with our lives.
So while many may question his decision to open fire — especially the second volley that came after Yatim was already on the ground and dying — does that mean Forcillo should go to prison?
“What the prosecution is really doing,” warned Brauti, “is trying to criminalize a judgment call which is a very dangerous thing to start doing when we are talking about a police officer’s ability to defend him or herself.”
The defence’s closing argument continues Wednesday.

Toronto police Const. James Forcillo, on trial for second degree murder, has pleaded not guilty to killing Sammy Yatim, whom he shot dead in a hail of gunfire.

The final witness in the murder trial of Toronto police Const. James Forcillo was forced to interrupt her testimony as she sobbed uncontrollably while the court heard audio of her 911 call on the night Sammy Yatim died.
Bridgette McGregor, 27, spoke through tears with a quavering voice as she described the terror and chaos on the Dundas St. streetcar in July 2013.
She had gone to a Justin Bieber concert that night with her niece and two sisters, and the group was sitting at the back of the streetcar next to Yatim when he pulled out a knife and exposed his penis, McGregor said.
“I need you to know that Yatim was dangerous,” she told the jury after she broke down crying on the stand.
Forcillo is on trial for second degree murder. He has pleaded not guilty.
The court has heard that the 18-year-old pulled a knife on a crowded streetcar, causing the passengers to flee.

He was then shot and killed by Forcillo as he stood alone at the front of the empty streetcar.
On Tuesday, McGregor and her older sister Christy were the last witnesses called by defence lawyer Peter Brauti.
Speaking through tears, the sisters described how they attended a concert at the Air Canada Centre, walked by the CN Tower taking pictures, then took the Spadina streetcar north to board the westbound streetcar on Dundas St. W.
The three women and 12-year-old girl sat at the back of the streetcar, next to Yatim, who stuck out his leg as they sat talking about the concert and boy bands from their youth.
“I was uncomfortable because he was shifty at first,” said Christy McGregor. “Now I’m getting on guard. I’m thinking, ‘This is weird.’ ”
She said that she then noticed her daughter’s eyes get wide.
“The next thing I see is a flash of silver and I realize, ‘Oh my God it’s a knife,’ ” she told the court.
Yatim then reached out with the knife and held it near her sister Bridgette’s neck, Christy McGregor said.
“I was sure he got her, it came so close,” she said. “Screaming starts. All hell breaks loose at this point.”
Bridgette McGregor said she doesn’t recall the knife near her neck, but that she agrees that it happened, because she has seen video of the incident from inside the streetcar.
“I didn’t notice the knife at first. I only noticed he had his penis out,” she said while crying on the stand. “He was pulling on it. Masturbating . . . .The next thing, I remember is he’s standing in front of me.”
She said Yatim told her she’s “not going anywhere,” and that she held up her purse with her hand behind it to block the knife as Yatim pressed it toward her.
She managed to “scurry” around him and run toward the front of the streetcar, she said.
“I yell, ‘Open the doors, why won’t you open the doors? He has a knife!’ ”
When the doors opened, the group ran west for about a block because they feared Yatim could be chasing them, she said. They stopped when someone suggested calling 911.
Audio of the call was played in court, but cut short as Bridgette McGregor began to shudder and weep at the sound of her screaming voice in the recording.
Moments later under cross-examination from Crown lawyer Ian Bulmer, McGregor said the recording captured the moment that shots rang out on Dundas St., and that, at the time, she feared that Yatim was firing a gun.
“You’re glad he was shot by police that night,” Bulmer suggested.
Bridgette McGregor responded: “No.”
Bridgette and Christy McGregor said they didn’t tell their story to police or have any interactions with law enforcement until after Yatim was shot.
The trial resumes Jan. 5 when the Crown and defence begin their closing arguments.
